  1. {STATE of MAINE, USA} MRS Title 29-A 2056 (4) [ Pedestrians in marked crosswalks.] states “When traffic-control devices are not in operation, an operator must yield right-of-way to a pedestrian crossing within a marked crosswalk.”
    I think this law is vague. I`ve done a great deal of research on the subject from the pedestrian point of view and here are some examples of how some operators “approach” the law;
    1. A pedestrian enters a marked crosswalk of a two lane street–the operator on the far side of the street proceeds through the crosswalk because the pedestrian hasn`t reached that side yet.
    2. A pedestrian reaches the center of a two lane street in a marked crosswalk –the operators on both sides of the street proceed through the crosswalk because the pedestrian isn`t on either side of the street so there is no need to “yield the right-of-way”.
    3. A pedestrian in a marked crosswalk, in the process of exiting the crosswalk–the operator on the same side proceeds through the crosswalk BEFORE the pedestrian has left it.
    4. A pedestrian entered a marked crosswalk at an intersection, WITH A TRAFFIC-CONTROLLED DEVICE(WALK LIGHT–20 SECOND DELAY)(17 seconds left), wearing a FLUORESCENT ORANGE VEST, is met by an operator making a RIGHT TURN ON RED LIGHT (legal in the STATE OF MAINE,USA). There was no RED ARROW LIGHT at the intersection to prevent the operator from proceeding through the crosswalk while the pedestrian was in it.

    I think the law should be changed to–” operators from any direction shall come to a complete stop when a pedestrian(s) enter(s) a marked crosswalk and proceed when the pedestrian(s) have completely left the crosswalk.”

    1. “I think the law should be changed to-” reflect the wisdom of a reasonable person who acknowledges the self-evident inalienable right to freedom of movement using his feet being able to exercise that right without threat from those who have the PRIVILEGE to drive on the roads the State allows them to use.

    1. A crosswalk is a legal fiction for an area of protection for citizens from negligent homicide. Texting and drunk driving are exactly the same issue. Both cause lethal negligence and both should be treated as a threatening gesture with a deadly weapon. Speed aggravates this. At 20 mph, we have a 90% chance of survival. At 30 mph, that drops to only and even chance. At 40 mph, we have a 90% chance of DEATH. At 70, you can drop all those to 10 mph less than a 30 year old.
